Welcome to Sports Picker. By creating an account, joining a pool or using sports-picker.app, you agree to these terms. If you don't agree, please don't use the service.
1. What Sports Picker is
Sports Picker is a product of ResQWare LLC, a New Hampshire limited liability company ("ResQWare", "we", "us"). These terms are an agreement between you and ResQWare. Sports Picker is a free-to-play entertainment service for running sports prediction pools with friends, family and coworkers. It keeps score; it is not a sportsbook. We do not accept wagers, collect entry fees, hold money or pay out winnings.
2. No gambling
You may not use Sports Picker to run or take part in illegal gambling. If members of a private pool choose to exchange money among themselves, that arrangement is entirely between them and not part of the service. Commissioners and players are responsible for following the laws where they live, which vary by state and country. Prize tracking in the app is a record-keeping tool only.
3. Sponsored and featured pools
Sponsored pools are always free to enter, and no purchase is necessary to enter or win. Unless their official rules say otherwise, they are open to legal residents of the 50 United States and D.C. who are 18 or older, and they are void where prohibited. Each sponsored pool has its own official rules covering eligibility, prizes, how winners are chosen and how ties are broken; those rules control if they conflict with these terms. Prizes are provided by the named sponsor, and winners may be asked to confirm eligibility before receiving a prize. Taxes on prizes are the winner's responsibility.
4. Your account
- You must be at least 13 years old to create an account.
- Give accurate information and keep your password private. You're responsible for activity on your account.
- One person per account. Don't create accounts for people without their permission.
5. Commissioners
Commissioners set up pools, invite members and choose the rules. Commissioners agree to invite only people who want to be invited, to run their pools fairly, and to decide disputes within their pool. A commissioner's decision on their pool's rules is final within that pool. Commissioners must not use members' email addresses for anything other than the pool.
6. Picks, scores and accuracy
Schedules, start times, TV listings and scores come from third-party sources and may be delayed, changed or occasionally wrong. Games can be postponed, canceled or moved. We try to keep everything accurate, and commissioners can make corrections, but we are not responsible for errors in third-party data or for outcomes in any pool. Picks lock at the times shown in the app; locked picks can't be changed, except by a commissioner's late pass.
7. Ask Tucker and AI features
Ask Tucker and the schedule importer use artificial intelligence. AI answers can be incomplete or wrong, so double-check anything important, and review imported schedules before saving them. Tucker's answers are for entertainment and general information only. They are not betting, financial or professional advice. Don't enter personal or sensitive information into AI features.
8. Chat and community rules
Friendly trash talk is the point; actual harassment is not. You agree not to post content that is threatening, hateful, sexually explicit, harassing, illegal, or that shares someone's private information. Don't spam, impersonate others, or try to break or overload the service. Commissioners can remove messages and members in their pools, and we may remove content or suspend accounts that break these rules.
9. Your content
You own the messages and content you post. You give us permission to store, display and share that content within the service so your pools work (for example, showing your chat messages to other pool members). You're responsible for what you post.
10. Our content and trademarks
The Sports Picker name, logo, Tailgate Tucker character, artwork and software belong to Sports Picker. Team, league and player names belong to their owners and are used only to identify games and results. Sports Picker is not affiliated with, endorsed by or sponsored by any league, team, player or broadcaster.
11. Sponsored messages
Pools may show labeled ads, from sponsors we work with directly or from advertising partners such as Google. Advertisers are responsible for their offers and websites; we don't endorse them. We don't accept ads for sportsbooks, gambling, tobacco, vaping or adult products. Ad-free, a Pool Pass or Commissioner Pro removes them.
12. Paid plans
Some features or larger pools may be offered on paid plans. ResQWare LLC sells them, and payments are processed securely by Stripe, so your receipt and card statement may show ResQWare. If you buy one, the price, billing period and what's included will be shown before you pay, and you can cancel future renewals anytime. Refunds are covered in section 13.
13. Refunds and chargebacks
All sales are final. Pool Passes, Commissioner Pro, Ad-free and add-ons are digital services that are turned on and available as soon as your payment goes through, so we don't offer refunds once a purchase is complete. That includes passes you haven't used yet, time left in a plan period, and purchases you stop using.
Case-by-case review. If something went wrong, such as a duplicate charge or a feature that didn't work as described, email support@sports-picker.app with the email on your account and what happened. We review each request individually, and any refund is at our discretion. If we refund a purchase, what it unlocked is removed, for example unused Pool Passes, a pool's Pool Pass, Ad-free or Pro.
Renewals. Commissioner Pro renews each year until you cancel. Cancel anytime from Plan & billing before the renewal date to avoid the next charge. Renewals already charged follow the same policy.
Chargebacks. Please contact us before disputing a charge with your bank or card company; most problems can be fixed quickly that way. If a charge is disputed, we may suspend the paid features tied to it, and the account, while the dispute is open. If the dispute is decided in your favor, the purchase is reversed and its features are removed. Disputing a valid charge for a service you received may lead to the account being closed.
Nothing in this section limits any rights you have under the law where you live.
14. Ending your use
You can stop using Sports Picker at any time and ask us to delete your account. We may suspend or close accounts that break these terms or put the service or other users at risk. We may change or discontinue features, and we'll try to give notice of significant changes.
15. Disclaimers
Sports Picker is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We don't promise that the service will be uninterrupted, error-free or that data will never be lost.
16. Limitation of liability
To the fullest extent the law allows, ResQWare LLC and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the service. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim or $50.
17. Indemnity
If you use the service in a way that breaks these terms or the law (for example, running an illegal betting pool) and that leads to a claim against us, you agree to cover the resulting costs, including reasonable legal fees.
18. General
These terms are governed by the laws of the State of New Hampshire and of the United States, without regard to conflict-of-law rules. If any part of these terms can't be enforced, the rest still applies. We may update these terms; if we make significant changes we will update the date above and let account holders know. Continuing to use the service after changes means you accept them.
